So I've seen this a few times a player with a Eagle or Fellbeast fly's to a spot on the table that no other models can access . Like 3rd tier of a ruined building or a hill with sheer cliff faces. Is this a legal move?

Depends if you deem the spot impassable before the game starts. Both players should agree on the terrain before the game starts to stop issues like that arising during the game. If you have different opinions, roll a dice.

I agree with SD's idea to an extent. Frankly, I was told before as per the rules, as long as a models base can fit on it, he can fly or climb there.

As for the distance, I usually try to measure distance in a straight line over the objects. I frankly dont see why anything on the battlefield that could physically be perched upon, shouldnt. I fell beast, eagle, or other such creature could fly extremely high as we've seen on film. The only battlefield limit is obviously the creatures movement.

Aye, it's all about what you agree on beforehand. If, for example, you want to recreate a Fellbeast tearing down ranks of Minas Tirith archers on the walls of that city, you may even want to allow the creature to charge where its base can't physcially be placed (which would otherwise require very few defenders and/or rather a wide wall). Simply placing a model somewhere others can't get to it at all doesn't seem like a lot of fun.
